OutKast vs. Rosa Parks Update
Judge rules Parks doctor must explain why she can't testify

DETROIT, MI  [Tuesday Aug.3.2004]  /Mix103FM.com/ -- Here's the latest on Rosa Parks' lawsuit against OutKast and the rap duo's record label. A federal judge ruled last Thursday (July 29) that if the civil rights icon is unable to testify, her doctor must explain why. Parks is suing OutKast for using her name without permission in a song's title on 1998's Aquemini. The lawsuit claims that Parks' name was exploited for commercial purposes and that the use of her name in the song is false advertising and infringes on her trademark rights.

OutKast's lawyers had asked to interview Parks to have her explain the emotional and mental distress she suffered due to the song.

The federal judge also excluded OutKast from the lawsuit, making BMG the sole defendant. OutKast was removed by the court because neither of the group's members was named in the suit. The group's name was incorrect as well.
